This website and services are operated under the brand Pixel Builder, owned and managed by Sanity Gaming LLP (hereinafter referred to as the "Company").

By accessing this website, engaging our services, or making any payment, you agree to be bound by these Terms & Conditions, along with our Privacy Policy and Commercial Terms.

The Company provides services including but not limited to:

• Website design and development
• UI/UX design and branding
• Digital marketing services
• Public Relations (PR) distribution (reseller basis)
• Domain registration, hosting, and related services (reseller basis)

All services are provided subject to mutually agreed proposals, invoices, or written communication.

A legally binding agreement is formed when the Client:

• Makes any payment
• Accepts a proposal or quotation
• Confirms acceptance via checkbox or written communication

Such acceptance includes agreement to all applicable policies.

The Client agrees to:

• Provide accurate and complete information
• Share required materials/content on time
• Review and approve deliverables within reasonable timelines

Delays from the Client may affect delivery timelines and do not constitute a breach by the Company.

All payments shall be governed by the Commercial Terms.

Key principles include:

• Advance payment required before work begins
• Full payment required before final delivery
• Non-payment may result in suspension of services

• All work remains the property of the Company until full payment is received
• Upon full payment, ownership of final deliverables is transferred to the Client
• The Company retains the right to showcase work in its portfolio unless otherwise agreed in writing

• Services are limited to the agreed scope
• Any additional work beyond scope will be charged separately

Certain services are provided via third-party providers, including:

• PR distribution platforms
• Hosting and domain providers
• Marketing tools and integrations

The Client acknowledges that:

• The Company acts as an intermediary/reseller
• Final service delivery depends on third-party providers

The Company does not guarantee:

• Media coverage or PR outcomes
• Search rankings, traffic, or leads
• Business growth or revenue

All services are provided on a best-effort basis.

To the maximum extent permitted by law:

• The Company's total liability shall not exceed the amount paid by the Client
• The Company shall not be liable for indirect, incidental, or consequential damages, including loss of profits, business, or data

The Client agrees to indemnify and hold harmless Sanity Gaming LLP against:

• Claims arising from content provided by the Client
• Legal violations (copyright, trademarks, etc.)
• Misuse of services

The Company shall not be responsible for:

• PR rejection or editorial decisions
• Hosting downtime or server issues
• Domain-related issues (expiry, suspension, DNS errors)

All such matters are governed by respective third-party providers.

The Company reserves the right to:

• Suspend or terminate services in case of non-payment or breach
• Withhold deliverables until dues are cleared

The Company shall not be liable for delays or failure due to events beyond its control, including but not limited to natural disasters, technical failures, or government actions.

In the event of any dispute, the parties shall first attempt to resolve it amicably. If unresolved within 15 days, the dispute shall be referred to mandatory arbitration governed by the Arbitration and Conciliation Act, 1996.

• Arbitrator: Sole arbitrator appointed by the Company

The decision shall be final and binding.

Courts shall have jurisdiction only for enforcement or interim relief.

These Terms shall be governed by the laws of India.

Jurisdiction: Kolkata, West Bengal.

All communication shall be conducted via email, WhatsApp or as per the client preference.

The Client is responsible for maintaining accurate contact details.

The Company reserves the right to update these Terms at any time.

Continued use of the website or services constitutes acceptance of updated Terms.
